We aim to describe 3 Steps Data accurately and clearly.
Product features, availability, supported regions, currencies, technical capabilities, interfaces and pricing may change as the service develops.
Website descriptions are general information and do not override the Terms of Service or any specific contractual terms applicable to your subscription.
Where information on this website differs from the terms governing your use of the service, those contractual terms prevail.
4. Data Vaults and Data Connections
3 Steps Data provides infrastructure that allows Data Vault operators to stage and store Customer Content in a Data Vault and create controlled Data Connections with people, organisations or systems.
A Data Vault operator decides:
what Customer Content is placed in the Data Vault;
which Data Connections are created;
who or what may connect;
what information is made available; and
what permissions apply.
3 Steps Data does not make those decisions on the operator’s behalf.
5. Customer Content
3 Steps Data does not create, approve or endorse Customer Content merely because that content is stored in a Data Vault or transmitted through a Data Connection.
We do not guarantee that Customer Content is accurate, complete, current, lawful, appropriate or suitable for any particular purpose.
Users remain responsible for the information they upload, provide, disclose, receive or rely upon.
6. Communications between users
Communications transmitted using 3 Steps Data are communications between the relevant participants.
3 Steps Data is not responsible for statements, representations, instructions, requests, documents, advice or other communications sent by one participant to another.
The fact that information was transmitted through a Data Connection does not mean that 3 Steps Data has reviewed, authenticated or endorsed that information.
Users should exercise their own judgement and obtain appropriate professional advice or further verification where necessary.
7. Trust Verification
3 Steps Data provides Trust Verification functionality that allows a user to check whether a Data Connection or service link is an authentic 3 Steps Data link.
Trust Verification verifies the relevant 3 Steps Data link.
It does not verify or guarantee:
the identity of the person using the link;
that a person has authority to act for a particular organisation;
the trustworthiness of a person, organisation or system;
the accuracy or authenticity of Customer Content;
the truth of a communication; or
the safety or commercial merits of a proposed transaction or relationship.
Users remain responsible for deciding whether to connect, communicate, disclose information or proceed with a transaction.
8. Downloads and the limits of control
A Data Vault operator may permit another participant to download information through a Data Connection.
Once information has been legitimately downloaded, the resulting copy is outside the Data Connection.
The permissions applied to that Data Connection no longer control the downloaded copy.
3 Steps Data cannot control how a recipient uses, stores, copies, forwards or distributes a legitimately downloaded copy.
9. Security
We design and operate 3 Steps Data with security, privacy and resilience in mind.
No online service can guarantee uninterrupted availability, complete protection from every possible security threat or absolute prevention of information loss, misuse or unauthorised access.
Users remain responsible for protecting their own credentials, selecting appropriate permissions, deciding what information to disclose and maintaining any independent backup, archival or continuity arrangements appropriate to their circumstances.
10. Service availability
3 Steps Data may occasionally be unavailable because of maintenance, upgrades, faults, telecommunications failures, hosting failures, security incidents, third-party outages or circumstances outside our reasonable control.
Unless expressly agreed otherwise in writing, we do not guarantee continuous or uninterrupted service availability.
11. Third-party services
The website or service may link to, rely upon or interoperate with third-party services.
Those services are operated independently and may be governed by their own terms, privacy policies and security practices.
3 Steps Data is not responsible for the operation, content, availability, accuracy, security or conduct of a third-party service that we do not control.
12. No responsibility for user decisions
3 Steps Data provides technology infrastructure.
We are not responsible for decisions made by users about:
what information to store or disclose;
who or what to connect with;
what permissions to grant;
whether to permit a download;
whether information received from another participant is accurate or trustworthy;
whether to act on a communication;
whether another participant has appropriate authority; or
whether a transaction or relationship should proceed.
Users remain responsible for their own judgement, verification, due diligence and professional obligations.
13. No implied warranties
Subject to rights that cannot lawfully be excluded, information on this website and the service are provided on an “as available” basis.
To the maximum extent permitted by law, 3 Steps Data does not give any implied warranty or representation that:
the website or service will always be available, uninterrupted or error-free;
every defect will be corrected;
the service will be immune from every possible security threat;
Customer Content will always be recoverable;
Customer Content supplied by another participant is accurate or lawful;
another participant will act honestly, lawfully or competently; or
the service will satisfy every legal, regulatory, professional or business requirement.
14. Limitation of liability
Nothing in this Disclaimer excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.
Subject to those rights and to the maximum extent permitted by law, FLATWORLD INTEGRATION PTY LTD, trading as 3 Steps Data, is not liable for indirect, incidental, special, exemplary, punitive or consequential loss or damage arising from or connected with this website or the 3 Steps Data service.
Without limiting the preceding paragraph, we are not liable for:
loss of profit;
loss of revenue;
loss of business;
loss of opportunity;
loss of anticipated savings;
loss of goodwill or reputation;
loss of contracts;
business interruption;
loss resulting from inaccurate, incomplete, misleading or fraudulent Customer Content or communications;
loss caused by another user, participant or recipient;
loss arising because Customer Content was sent to an unintended recipient;
loss arising from permissions selected by a Data Vault operator;
loss arising from a legitimately downloaded copy of Customer Content being used, stored, copied, forwarded or distributed outside the Data Connection;
loss arising from reliance on Trust Verification as proof of another participant’s identity, authority or trustworthiness; or
consequential loss arising from loss, corruption, disclosure or unavailability of data.
Where liability cannot lawfully be excluded but may be limited, our liability is limited to the extent permitted by applicable law and, where legally available, may be limited to supplying the relevant service again or paying the reasonable cost of having the service supplied again.
Any additional contractual limitation of liability applying to a customer is set out in the 3 Steps Data Terms of Service.
15. Intellectual property
Unless otherwise stated, the content of this website, including text, graphics, branding, logos, designs and other materials, is owned by or licensed to FLATWORLD INTEGRATION PTY LTD and is protected by applicable intellectual-property laws.
You may not reproduce, modify, distribute, republish or commercially exploit this content without permission except where permitted by law.
